BMW
of North America, LLC (BMW
) is recalling certain 2024 i5 eDrive40 and i5 M60 vehicles. During vehicle start-up, the artificial sound generator control unit may experience a fault and fail to generate the external pedestrian warning sound. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard number 141, “Minimum Sound Requirements for Hybrid and Electric Vehicles.”
Remedy
Dealers will update the external artificial sound generator software, free of charge. Owner notification letters are expected to be mailed February 13, 2024. Owners may contact BMW
customer service at 1-800-525-7417. Note: This is an expansion of Recall 23V-026.

AFFECTED VEHICLES
Vehicles which require this campaign to be completed will show it as “Open” when checked either in AIR, AWP, Campaign Summary or Warranty Vehicle Inquiry.

SITUATION
BMW
AG has issued a Delivery Stop (effective December 8, 2023) on certain Model Year 2024 BMW
vehicles that were produced between June 26, 2023, and December 14, 2023.
As of December 15, 2023, this Delivery Stop has been upgraded to a Non-Compliance Recall.
In rare cases, a communication fault can occur in the CAN bus during vehicle start-up in relation to the Reciver Audio Module (RAM). In the event of a fault, the acoustic pedestrian warning sound is not activated. The “Acoustic Pedestrian Protection Failed” CCM is also not activated. Vehicle occupants will be unable to detect that there is a fault.
Do not deliver to a customer, a New, Certified Pre-Owned or Used vehicle subject to a Delivery Stop, until the vehicle is repaired. Do not use or sell replacement equipment/parts subject to a Delivery Stop.

CAUSE
Unfavorable software in the Receiver Audio Module (RAM).
CORRECTION
Program the RAM.
PROCEDURE
Determine what is the vehicle’s current I-level by either using AIR or the AWP (Aftersales Workplace) applications.
Based the the vehicle’s current I-level, if necessary, program the vehicle to I-level G070-23-11-547 or higher using ISTA 4.45.22 or higher (estimated release December 15th, 2023, pending verification).
Connect the battery charger to the vehicle
Connect the programming system to the vehicle (ISTA 4)
Determine measures plan
Accept and fully work through the measures plan with the control units to be programmed/encoded and enabled Follow the rework list
Depending on the rework list, carry out a vehicle test and delete the fault memory if needed
After the programming has been fully completed, check functionality of the system.
Note: ISTA will automatically reprogram and code all programmable control modules that do not have the latest software.
Always connect a BMW
-approved battery charger/power supply (SI B04 23 10).

Chronology :
On September 21, 2023, subsequent to the activities conducted that led to 23V-026, additional vehicle models were evaluated. A data logger was installed on a number of BMW
i5 pre-production vehicles to collect information pertaining to the activation of the external artificial sound generator. The data collection activity was scheduled to run until November 29th.
Toward the end of November, at the end of the test program, involving multiple vehicles and approximately 100,000 miles, the data indicated that, in very rare cases, the external artificial sound generator control unit may not have appropriately activated the sound generator. Preliminary information indicated that the condition was difficult to reproduce.
In December, further analyses were conducted, which also indicated that the rate of occurrence of the issue was approximately one order of magnitude lower than the rate in 23V-026 which itself was near 1%. As a precaution, a vehicle stop ship was issued at the vehicle assembly plant on December 8th. A review of regulatory requirements including FMVSS 141 was performed. A review of field data did not indicate any customer complaints, warranty claims, or field reports that may be related to this issue.
On December 15, 2023, BMW
determined that potentially affected vehicles may not fully conform to FMVSS 141 Section 5 and decided to conduct a voluntary non-compliance recall.
BMW
has not received any reports, nor is BMW
otherwise aware, of any accidents or injuries that may be related to this issue.

ISTA/P Online - Control Module Reprogramming
With ISTA/P you can reprogram the onboard control modules that are capable of software reprogramming. For ISTA/P, a data interface, a power supply and an Internet connection are required. The data interface can be a BMW
Group ICOM interface or a "Pass-Thru Tool (PTT)" that fulfills the requirements of the SAE J2534 standard.
What is needed to diagnose and program with the BMW
OSS?
The OSS consists of a desktop or laptop PC connected to BMW
over the Internet. To connect to the vehicle you can use the BMW
authorized diagnostic interface "integrated communication optical module (ICOM)" or use a J2534 "Pass Thru Tool (PTT)".
Note
Connection to OSS works only on PCs where no proxy connections are used.

RE: Recall 23V-xxx: Receiver Audio Module – B65 37 23 BMW
AG has issued a Delivery Stop (effective December 8, 2023) on certain Model Year 2024 BMW
vehicles that were produced between June 26, 2023, and December 14, 2023.
As of December 15, 2023, this Delivery Stop has been upgraded to a Non-Compliance Recall. Please be reminded that it is a violation of federal law (The Safety Act) for you to sell, lease or deliver any new motor vehicle covered by this notification until the recall repair has been performed. This means that Centers may not legally deliver new motor vehicles to consumers until they are fixed or use/sell replacement equipment/parts subject to this recall. Note also that substantial civil penalties apply to violations of the Safety Act. Also, you should not sell, lease or deliver any Certified Pre-Owned or used vehicles subject to a safety recall until the repair is completed. AG has issued a Delivery Stop (effective December 8, 2023) on certain Model Year 2024 BMW
vehicles that were produced between June 26, 2023, and December 14, 2023. As of December 15, 2023, this Delivery Stop has been upgraded to a Non-Compliance Recall. In rare cases, a communication fault can occur in the CAN bus during vehicle start-up in relation to the Reciver Audio Module (RAM). In the event of a fault, the acoustic pedestrian warning sound is not activated. The “Acoustic Pedestrian Protection Failed” CCM is also not activated. Vehicle occupants will be unable to detect that there is a fault. The Recall Notice and Q&A have been attached for further information.

This non-compliance recall involves the external artificial sound generator control unit. During vehicle start-up, the control unit may, sporadically, experience a fault condition. As a result, the control unit software may not, in certain vehicle operating conditions, generate the required external artificial sound. On September 21, 2023, subsequent to the activities conducted that led to 23V-026, additional vehicle models were evaluated. A data logger was installed on a number of BMW
i5 pre-production vehicles to collect information pertaining to the activation of the external artificial sound generator. The data collection activity was scheduled to run until November 29th. Toward the end of November, at the end of the test program, involving multiple vehicles and approximately 100,000 miles, the data indicated that, in very rare cases, the external artificial sound generator control unit may not have appropriately activated the sound generator. Preliminary information indicated that the condition was difficult to reproduce. In December, further analyses were conducted, which also indicated that the rate of occurrence of the issue was approximately one order of magnitude lower than the rate in 23V-026 which itself was near 1%. As a precaution, a vehicle stop ship was issued at the vehicle assembly plant on December 8th. A review of regulatory requirements including FMVSS 141 was performed. A review of field data did not indicate any customer complaints, warranty claims, or field reports that may be related to this issue. On December 15, 2023, BMW
determined that potentially affected vehicles may not fully conform to FMVSS 141 Section 5 and decided to conduct a voluntary non-compliance recall. BMW
has not received any reports, nor is BMW
otherwise aware, of any accidents or injuries that may be related to this issue.
Description of Remedy :
Description of Remedy Program : Potentially affected vehicles will be programmed with updated external artificial sound generator software.
Owners will be notified by First Class mail and instructed to take their vehicle to an authorized BMW
dealer to have the remedy performed for free. If this condition were noticed on a potentially affected vehicle prior to this recall, the remedy would be covered by the BMW
New Vehicle Limited Warranty program. Therefore, reimbursement for a pre- notification remedy re Part 573.13 and Part 577.11 is not necessary.
