Please be reminded that it is a violation of federal law (The Safety Act) for you to sell, lease or deliver any new motor vehicle covered by this notification until the recall repair has been performed. This means that Centers may not legally deliver new motor vehicles to consumers until they are fixed or use/sell replacement equipment/parts subject to this recall. Note also that substantial civil penalties apply to violations of the Safety Act. Also, you should not sell, lease or deliver any Certified Pre-Owned or used vehicles subject to a safety recall until the repair is completed. Address : Průmyslový park 302 Kopřivnice Foreign States 74221 Country : Czech Republic Chronology : On May 2, 2023, during a technical development test involving a future vehicle type, and using a driver’s seat design and production configuration that is the subject of this recall, it was noticed that the seat experienced an unusual movement during the test. An engineering investigation was initiated. The seat supplier was immediately contacted, discussions with the supplier occurred, and the supplier reviewed their production records and processes. The supplier determined that, due to a fluctuation in the production process, there was an insufficient weld involving the seat length adjustment system. The records indicated that during a specific and limited production period, welding may not have been performed according to specifications due to an inappropriate joining of parts. Vehicle assembly information and supplier production and process records were reviewed to determine the number, and production dates, of potentially affected vehicles. On June 1, 2023, BMW decided to conduct a voluntary safety recall. BMW has not received any reports, nor is BMW otherwise aware, of any accidents or injuries related to this issue. Description of Remedy : Description of Remedy Program : The front seats will be inspected and, if necessary, the seat front structure including the seat length adjustment system will be replaced. Owners will be notified by First Class mail advising them of the recall and to schedule an appointment with an authorized BMW dealer to have the remedy performed for free. If this condition were to occur to a potentially affected vehicle prior to this recall, the remedy would be covered by the BMW New Vehicle Limited Warranty program. Therefore, reimbursement for a pre-notification remedy re Part 573.13 and Part 577.11 is not necessary.
