Summary
BMW of North America, LLC (BMW
) is recalling certain 2022-2023 i4 eDrive40 and iX xDrive50 electric vehicles. During vehicle start-up, the artificial sound generator control unit may experience a fault and fail to generate the external pedestrian warning sound. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard number 141, “Minimum Sound Requirements for Hybrid and Electric Vehicles.”
Remedy
Dealers will update the external artificial sound generator software, free of charge. Owner notification letters were mailed March 9, 2023. Owners may contact BMW customer service at 1-800-525-7417.

SITUATION
BMW AG is conducting a Voluntary Non-Compliance Recall (effective January 19, 2023) on certain Model Year 2022 – 2023 BMW
iX SAV vehicles that were produced between January 13, 2022 and December 21, 2022.
Potentially affected vehicles may not generate the external artificial sound at low vehicle speeds, e.g., while slowing down at an intersection, and therefore may not meet Federal requirements.
CAUSE
Unfavorable software in the Receiver Audio Module (RAM).
CORRECTION
Program the Receiver Audio Module (RAM).
PROCEDURE
Program the vehicle to I-level I020-22-11-563 or higher using ISTA 4.39.36 or later (planned release date is February 9, 2023, pending verification).
Connect the battery charger to the vehicle
Connect the programming system to the vehicle (ISTA 4)
Determine measures plan
Accept and fully work through the measures plan with the control units to be programmed/encoded and enabled
Follow the rework list
Depending on the rework list, carry out a vehicle test and delete the fault memory if needed
After the programming has been fully completed, check functionality of the system.
Note: ISTA will automatically reprogram and code all programmable control modules that do not have the latest software.
Always connect a BMW-approved battery charger/power supply (SIB 04 23 10).

Chronology :
On December 14, 2022, during a quality check at a vehicle assembly plant, it was noticed that a 2023 BMW iX did not generate an external artificial sound. During this check, it was also noted that this condition occurred sporadically. An engineering review was initiated.
Tests and analyses were performed on a range of vehicles which contained various option packages.
Preliminary analyses indicated that some test vehicles experienced the condition sporadically, while other test vehicles did not exhibit the condition.
Additional tests and analyses were conducted. A review of regulatory requirements including FMVSS 141 was performed. It was not yet clear which vehicle build configurations were potentially affected and, if so, either sporadically, or more frequently.
Further analyses involving vehicle assembly information, production system records, and vehicle build configuration specifications including software coding levels were reviewed. These reviews were conducted to determine the specific vehicle models and option packages that could potentially be affected.
On January 18, 2023, BMW determined that potentially affected vehicles may not fully conform to FMVSS 141 Section 5 and decided to conduct a voluntary recall.
BMW has not received any reports, nor is BMW
otherwise aware, of any accidents or injuries that may be related to this issue.

ISTA/P Online - Control Module Reprogramming
With ISTA/P you can reprogram the onboard control modules that are capable of software reprogramming. For ISTA/P, a data interface, a power supply and an Internet connection are required. The data interface can be a BMW Group ICOM interface or a "Pass-Thru Tool (PTT)" that fulfills the requirements of the SAE J2534 standard.
What is needed to diagnose and program with the BMW OSS?
The OSS consists of a desktop or laptop PC connected to BMW over the Internet. To connect to the vehicle you can use the BMW
authorized diagnostic interface "integrated communication optical module (ICOM)" or use a J2534 "Pass Thru Tool (PTT)".
Note
Connection to OSS works only on PCs where no proxy connections are used.

Also, only one Main work flat rate labor operation code can be claimed per workshop visit. Claim Repair Comments Only reference the SIB number and the work package (Pkg) number performed in the RO technician notes and the claim comments (For example: B65 06 23 WP 1), unless otherwise required by State law. Programming and Encoding – Vehicle Control Units (RO and Claim Comments Required) This procedure automatically reprograms and encodes any vehicle control modules that do not have the latest software I-level. If one or more control modules fail during the reprogramming procedure, claim the required consequential repair work procedures to address this issue (including performing the IRAP Control Unit Recovery first as required, refer to the SIB in AIR) under the Defect Code in this bulletin with the labor operations in AIR that apply. Please be reminded that it is a violation of federal law (The Safety Act) for you to sell, lease or deliver any new motor vehicle covered by this notification until the recall repair has been performed. Connect the battery charger to the vehicle

Accept and fully work through the measures plan with the control units to be programmed/encoded and enabled

BMW AG is conducting a Voluntary Non-Compliance Recall (effective January 19, 2023) on certain Model Year 2022 – 2023 BMW iX SAV vehicles that were produced between January 13, 2022 and December 21, 2022. Potentially affected vehicles may not generate the external artificial sound at low vehicle speeds, e.g., while slowing down at an intersection, and therefore may not meet a Federal requirement. The Recall Notice and Q&A have been attached for further information. Software is expected to be available sometime in February. The bulletin will be updated when additional information becomes available.

Please be reminded that it is a violation of federal law (The Safety Act) for you to sell, lease or deliver any new motor vehicle covered by this notification until the recall repair has been performed. This means that Centers may not legally deliver new motor vehicles to consumers until they are fixed or use/sell replacement equipment/parts subject to this recall. Note also that substantial civil penalties apply to violations of the Safety Act. Also, you should not sell, lease or deliver any Certified Pre-Owned or used vehicles subject to a safety recall until the repair is completed. On December 14, 2022, during a quality check at a vehicle assembly plant, it was noticed that a 2023 BMW iX did not generate an external artificial sound. During this check, it was also noted that this condition occurred sporadically. An engineering review was initiated. Tests and analyses were performed on a range of vehicles which contained various option packages. Preliminary analyses indicated that some test vehicles experienced the condition sporadically, while other test vehicles did not exhibit the condition. Additional tests and analyses were conducted. A review of regulatory requirements including FMVSS 141 was performed. It was not yet clear which vehicle build configurations were potentially affected and, if so, either sporadically, or more frequently. Further analyses involving vehicle assembly information, production system records, and vehicle build configuration specifications including software coding levels were reviewed. These reviews were conducted to determine the specific vehicle models and option packages that could potentially be affected. On January 18, 2023, BMW determined that potentially affected vehicles may not fully conform to FMVSS 141 Section 5 and decided to conduct a voluntary recall. BMW has not received any reports, nor is BMW otherwise aware, of any accidents or injuries that may be related to this issue. Description of Remedy :
Description of Remedy Program : Potentially affected vehicles will be programmed with updated external artificial sound generator software.
Owners will be notified by First Class mail and instructed to take their vehicle to an authorized BMW dealer to have the remedy performed for free. If this condition were noticed on a potentially affected vehicle prior to this recall, the remedy would be covered by the BMW New Vehicle Limited Warranty program. Therefore, reimbursement for a pre- notification remedy re Part 573.13 and Part 577.11 is not necessary.
